San Diego, CA asked in Workers' Compensation for California

Q: After filing for & receiving a QME, how do I cancel it if I don't want to do it?

I filed a PMQE form out of fear of being put on permanent disability before seeing my treating physician. However, I haven't been & I no longer want to go ahead with the QME. They have sent me the paper with the 3 doctors they have picked but I'm not sure how to cancel my request.

A: IF YOU and not the adjuster filed for the QME Panel, just write to the adjuster that you will not be selecting nor scheduling any QME appointment because you now agree with the findings of the Primary Treating PHysician.

If the ADJUSTER requested the QME Panel, then you must pick and you must go.

If the Adjuster didn't object to the PTP opinion but now decides they want a QME opinion, and you fail to pick within the 10 days, the adjuster will pick the most horrific doctor on the list for you. Then the adjuster can get an order that you see Dr. Horrific or benefits would be suspended.

So EiTHER: (1) immediately get an agreement IN WRITING FROM THE ADJUSTER that no one will pick any physician from this QME Panel ever, and all parties are agreeing to the findings of the Primary Treating Physician, or (2) pick the best QME from the list you have, researching thoroughly who each doctor writes for and pick that one on the 10th day and set the appointment.
