Q: Can a tenant who pays rent, but is not on a lease in FL, get evicted even if he doesn’t cause problems?

My boyfriend and I, will be living together in an apartment in riviera beach, FL but only I will be on the lease. My bf has an eviction (8 years ago) on his record, a misdemeanor (couple of yrs ago) and bad credit. I have excellent credit, and a clean background. Our realtor told us that no landlord would accept his application, and I should do the process on my own. Him and his 4 year old son will be living with me. He will be paying rent and won’t cause any problems. Can he and his son be kicked out, if they find out they are staying with me? Can I get evicted as well? He can apply, but he won’t get accepted. He has no other place to go, and neither do I. What are his rights?

A: He would have no tenant rights because he would not be a lessee; you would. Whether you would be in breach of the lease for having "guests" such as your boyfriend and his son would depend on the terms of the lease. Review the lease before you sign it for restrictions on guests, etc.
