Q: Hi, is a joint lease valid if only one individual has signed and the second individual has not signed yet ?

My question above is in regards to signing an electronic lease reneweal that contains a subordination clause. After reading the lease thoroughly the second person refused to sign. Unless the lease could be amended to contain a non disturbance clause. At this point with less than a week to the months end. I want to know is the joint lease valid if only I have signed, and neither has the other or the landlord. Can we still negotiate a rental agreement on a month to month basis. Or is the lease valid with only my electronic signature attached.

A: An attorney would have to review the full lease. If the landlord has not signed, then it would not yet be valid. You can try discussing changes with landlord to revise the lease or re-negotiate it. Use the Find a Lawyer tab to consult a local real estate attorney.
