Waterloo, IL asked in Divorce for Illinois

Q: I am contemplating a divorce in IL and was wondering about a few questions. I've been married for 2 yrs and need to

know my legal rights as far as separation of finances and property. I sold my condo and my car and moved to another town. My husband funded our home solely but both our names are on the deed. He owns a business that he had before marrying. I have been receiving a paycheck for the last 2 yrs by overseeing and helping to make much needed improvements in all divisions. I came into the marriage with small investments and we have added some in single names and one in joint names. I have basically been a housewife and have no other job. My question is am I entitled to half of everything we own including his business and alimony? Thank you for your input.

A: Your question is difficult to answer responsibly without the benefit of a personal consultation where all of your facts can be determined. However, and generally, you have a valid claim for 50% of the house, for 50% of all accounts that were funded with marital earnings (no matter in whose name title is held), and a claim for four or so months of alimony (maintenance). The business, as such, will be awarded to him, but you may have some claim for reimbursement of any marital funds he sunk into the business, or to any of the business' retained earnings.
