Q: Is it possible to lose custody of my daughter?

I won sole legal and physical custody of my daughter last year after a 7 months custody battle. My mom watches her because i was training with the army. Now her mom and Mom side of the family is trying to take me to court to take her from me because i told them i am moving because i have a better job offer. I have not done anything wrong i haven’t got into any trouble and the only thing that happen was i had to let my mom watch her due to me training. Will they take my daughter away from me? I have proof of her saying when she get out of jail they will take her from me and plenty more threats.

A: In order to modify custody, she would need to establish that there has been a material change in circumstances that negatively impacts the child, which is a very heavy burden. That being said, in the right circumstances, moving from one place to another, even if for another job, can sometimes be enough to trigger a modification; however, that is in very particular circumstances. I would recommend getting with an attorney sooner rather than later, even if it just to go over the facts and circumstances surrounding you getting custody up to now, and that way you can have a good plan of action as you move forward.
