Lawrenceville, GA asked in Divorce and Child Custody for Georgia

Q: I'm a unemployed dad in school. My wife wants to get divorced asap, if we get divorced do I have any rights to my kids?

I'm concerned because if we get divorced now & I'm just finishing up school currently I may now have living arrangements together and could end up homeless. I should be finish school very soon but once I finish I don't know how long it is going to take me to find employment & find my own place. My biggest concern is my kids who I've I've been in their life their entire life. I'm trying my best to obtain employment, but I feel my wife will use the fact that I'm unemployed to her advantage in any way she can to keep me from my kids.

A: You would have rights to your children in a divorce. You need to consult with an attorney and discuss your options with them.

A: You will have rights to your children. You should work on securing an alternate residence. Stay in the marital residence unless and until there is a court order for you to leave, but have a backup plan that will be suitable for the children to visit you. Living with a family member would probably be best.

A: I can understand your concerns, but you will have rights to be with your children. The courts would not split you up simply because you are finishing school and not employed. It's important that you speak with an attorney so that they can help you plan your best course of action. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
