Q: If you receive food stamps can they take some money out of it if your ex isnt on child support?

My dad stated that he HAD to fill for child support on my mom because if he didn't they said that they would take $120 dollars out of his food stamps. It sounds fishy to me because why would they take something away if they need it. I told my mom about what happened and before my dad got custody of my brother my mom had child support filed on my dad and he rarely ever made payments and they never took money away from her food stamps.

A: Yes. Under certain circumstances they can. Right or wrong, the idea behind it is to encourage custodial parents to seek support from noncustodial parents and remove some of the burden for payment from the state. Those who comply are not penalized but those who don’t comply sometimes are penalized
