Q: Should I seek a family attorney or a real estate attorney?

I have been divorced for a few years but I still own a home with my ex. He wanted to refinance the home on his own, but excuse after excuse, year after year, has resulted in him purchasing a new home and renting our home out. He has had full use of the home since the split. I want nothing from the home, except to be off the mortgage. Supposedly unable to refinance it he has sought the advice of an attorney who is drawing up documents to supposedly indemnify me of any responsibility if he fails to make mortgage payments etc.. . I would like to seek an attorney to review said documents to make sure I am not doing something I should not. Should I seek a divorce/family attorney or a real estate attorney?

A: Don't sign that documents. You need a family law attorney to force a sale if he can't refinance.

A: I would suggest retaining a family law attorney to partition the property.
