Q: I am a landlord who's tenant is breaking a one year lease after 2 months. They are being extremely combative.

SIgned a one year lease

Dont want to pay rent for upcoming month even though they state they will be there for half of the month

A: You could evict them and then seek a judgment in your favor for the rent that is owed.

A: In addition to the other answer on eviction and suing for any rent they owe, you can advise them that if they don't pay what they owe, instead of suing them, you could make an adverse entry on their credit record, lowering their credit score and making it difficult to rent from a landlord who checks their credit. Also, having an eviction on their record will make it difficult to rent.

A: I agree with Mr Mathews. You should document all your efforts to prepare the premises to be rented and your efforts to find a new tenant. I recently saw a decision in which the Magistrate found that "future" damages was speculative, so I would attempt to delay the second cause of action until you find a new tenant.
