Delray Beach, FL asked in Child Custody and Family Law for Florida

Q: Can my ex get full custody of our 6 year old

I have a boyfriend that my ex doesn't like. My current b/f and I had a fight in front of my son, and my son, sticking up for mommy, was shooting nerf bullets and such so I had my ex pick up my son so that he would not be involved.

Later my ex bullied me into signing I document stating he would have my son at all time and that I would give him custody if this man was still in my life. I did sign it but since then there was the final hearing and a final order entering a 50/50 parenting plan and he did not bring it up to the Judge at the final hearing.

Now he is threatening me to take me to court for full custody unless I sign something saying that this man is never going to be around me or my child and going to file a restraining order against my boyfriend.

My ex has a history of violence, punching walls and fridges, arrested and taken to South County and verbally abusive and bulling me.

Will a judge give him custody due to what I signed?

A: No, the final judgment awarding 50/50 is the court order in effect. If he wants to change it he needs to go back to court.
