Q: been paying CS since found out child was mine at 18 months mother don’t wont child to have my last name. Have JLC 50/50

Found out child was mine at 18 months, started paying CS that was agreed upon, in Jan hired an attorney, because of visitation problems. We are now sharing JOint custody with both parents sharing physical custody 50/50 no domicile by either parent and I still am paying child support ( because I insist) . The mother refuses to change the babies last name to my name( can not give her or my attorney a reason) I think it’s to have leverage over me . My attorney says that we nor the judge can make her change the last name? She has once agreed to a hyphenated name ( her last name -mine) but refused when I accepted. Is there anything I can do??? We are going through Louisiana court because that’s where the babies domicile was prior to me knowing I was the father.

A: Nothing you can do. Mother of child has option of giving child her name, your name or hyphenated name AND SHE GETS TO CHOOSE.
