Oakland, CA asked in Medical Malpractice and Personal Injury for California

Q: How much money cap does Highland Hospital Oakland have for out of court settlements for injuries in surgery

Lidocaine did not work, held down on table by male nurse, injured my arm (shoulder capsulitis etc) and leg. Got home and was bleeding from cut artery, went back, put on table, held down again when lidocaine not work, had no suction, no retractors.

A: The MICRA cap for pain and suffering damages is $250k. However, that is for a winning case. Nothing that you wrote suggests or establishes medical negligence. It might be there, but you won't get anywhere claiming that you are owed money because lidocaine didn't work and you experienced pain.
