Q: A 16 yo f and a adult 28 yo f engaged in mutual combat. Can the adult get charges because the 16 yo is a minor in Texas?

The 16 yo has been caught on property several times trying to have relations with the adult females step son who is also 16. The adult female initiated the fight in the street across from her home and the 16 yo cussed and then engaged into mutual combat. Can the adult face any charges due to the 60 yo being a minor. Is there anything else the adult female needs to consider or any information needed or you would like her to know. The 16 yo has been in trouble for sleeping with several adult men and a constant runaway.

A: Either one of the individuals COULD be charged with assault; the age difference does not bar prosecution nor does it presume guilt on either party. The decision on whether to pursue criminal charges would be up to law enforcement.
