Q: Hello I am looking for advice on landlord/tenant and security deposit laws and rules. I'm hoping you can help. Thanks.

Recently moved from a pet friendly rental property after 2 years. The carpet was original in 2010 and was still in the unit when we moved in. Very worn in high traffic areas and didnt match throughout the unit. Carpet was offered to be replaced to match prior to our move in but we declined. After moving, landlord wants to keep security deposit to now replace carpet saying its bc it smells like pets. Its not damaged or stained in any way, just old and worn. Can he keep our security deposit? Additionally I'd like to say we paid a pet deposit and monthly pet rent for the entire 2 years.

You could sue landlord in small claims court for the return of the deposit, but it probably is not worth your time. If there are not photos of before and after, and a walk-through inspection before and after, it would be difficult to prove what was done to the carpet.
