Q: I have never been served papers and it's been 6 months since the case was opened. What are my options?

2.5 years ago I was involved in a car accident with two other drivers. The first driver and myself split the fault of the accident 30/70 ruling 70% the other drivers fault. The 3rd driver was ruled not at fault and the claim was settled and payments paid and case closed. 1 week from the 2 year mark of the accident the 3rd driver filed suit again myself and the other driver in small claims court. In my state there is a 2 year statute of limitations to file for a vehicle accident, this was filed one week before. Six months have gone by and I have yet to be served any papers and we are now almost 2.5 years since the original accident. I can look my case up online and it still says open but no mention of any court date and the last record entered was from 4 months ago. Since I've never been served do i need to worry about this. Will this get thrown out because nothing is happening? It’s stressful knowing that this is lingering. It also feels like a grab for money.

A: If you had insurance just notify them of the filing and let them handle it. I would send them a note, certified return receipt.
