Q: If a pregnant woman was in a wreck an was rushed to hospital an the doc never came to see her then see gets distcharged

A: If she wasn't injured by the discharge, then there is no claim against the ER or the doctor. If she later gets medical attention for the car accident, she may have a claim against the other driver.

A: It is possible that the hospital violated the Emergency Medical Treatment and Labor Act if you were needlessly endangered by failing to provide adequate medical care as defined in the surrounding medical community. You still have to show an injury, as I understand it. Please contact a medical malpractice attorney to discuss in detail.

In the absence of an injury, you can file a complaint with California Quality Improvement Organization for Medicare, which is Livanta. The hospital could face steep fines for failing to provide you with emergency medical treatment.
