Q: I have 2 children by the same man. He refuses to sign their birth certificate and refuses to take a dna test.

We always debate about this, he does not want to sign the birth certificates and when child support is brought up he says he will refuse a dna test by not responding. He does not support financially and does not even have a job. I am wanting to file child support. How am I able to get him on CS if he refuses and is not on their certificates? Both kids have his last name but that is all. I have all of his info from ssn to living address (his name is not on the lease but I know 100% he stays there) to his relatives addresses and so on. What will the court do if he does not respond to the dna test?

A: There are at least possibilities:

1) the court could order him to submit a DNA sample, and if he doesn't, hold him in contempt of court; or

2) He could be defaulted the child presumed to be his, and he would be ordered to pay child support.

Whether or not he "signs" the birth certificates, or not, is really immaterial.
