Q: Does my step sons fathers mother have any legal obligation to see the child?

We moved out of state with the child with child’s fathers permission and filed the paper work with the court. Now the fathers mother is bringing us to court for visitation with the child. Will she get visitation? Do the same laws apply now that we live out of state? We moved to get away from the fathers toxic family.

A: This is a complex question inasmuch as the particular facts of your matter are going to dictate what happens with a potential grandparent visitation claim -was this a divorce or paternity matter? What was the relationship between the grandparent and child? Have there been allegations of abuse or neglect of the child and is that an issue? How long have you and the child been living in the new state? If more than 6 months have gone by Massachusetts does not have jurisdiction over the child although there are some exceptions.
