Q: My mom went on vacation and left her dogs who just had puppies with the old owner. They gave her the dog not knowing she

Was pregnant from their other dog, when they came to get the puppies they specifically told my mom in front of us that they are her dogs and when she gets back she can come get them, now the lady wont answer my mom back and wouldnt let me go see the dogs while my mom was gone we have text message to prove its my moms dog and that she said we could come get them when my mom got back. and that she gave birth to my moms puppies at my moms house. (This was all a surprise and my mom had no idea she was pregnant until she was giving birth on her carpet) We were planning on giving the lady a puppy for her help and good faith when they were old enough to go to new homes. What can we do? We have her address. My mom just wants her dogs back, help please

A: You can try to sue her for replevin in small claims court, but it will be a he said she said situation as to who owns the mom and puppies. If they claim they didn't give the mother to your mom, then they still own her and the puppies. Typically whoever owns the mom owns the puppies, regardless of where they were born, so if they say they just had your mom watching her, then they may get to keep the dog and the puppies. If you do sue, there will be mediation mandated so potentially you could work it out without having to have a magistrate or judge decide.
