Q: What can I legally do if not being compensated for the job I am doing?

I have been employed for over 2 years working with my current employer. I love the company and my co-workers, but management lacks. I was originally hired on as a customer service rep to move into inside sales within a year. I was taking over a territory for the ISR that moved to outside sales. I took the position on the notion that after a year, learning the position and clients, that I would move into the ISR position. An ISR makes anywhere from $15-$20k more a year with quarterly sales bonuses. I have been doing the ISR job as well as the CSR job now since day one (3/14/16). In this time I have had to carry the territory I work, as well as all CSR duties, and I am being compensated for the lesser of the 2 positions. Missing out on commissions, and making sales on accounts that other ISR's are attached to earning towards their commissions. What legal action can/or should I take to be compensated properly? I don't want to lose my career over this, but it is my livelihood.

A: Employment is at-will in Florida, so unless you have an employment contract that guarantees you the ISR position after one year, there does not seem to be any legal action that you could take. Unfortunately, hiring an employee and changing the duties expected of the employee after they have started is common in at-will employment states.

I would suggest that you speak with management staff regarding the overwhelming amount of work you've been tasked with and ask for a raise. Point out all the money you have made with the company through the ISR work you've been doing, without being compensated. If they are not willing to pay you accordingly, it's probably time to take your talents elsewhere. There are plenty of companies out there that do value and appreciate their employees, and you deserve to work for one of them. Best of luck to you.
