Duluth, GA asked in Civil Litigation for Georgia

Q: How can I prevent a politician from using my child's photos for political endorsement and promos?

A family member is running for elected office in Georgia and I have asked him, in writing, to please stop using pictures of me, my wife and child and then claiming that we endorse his campaign. He will post images on social media (both official and personal) and claims in captions "(insert name) endorses (insert name) for (insert position) get out and vote for (insert name) on (insert date)." He has continued to do so even after written request to him and his campaign manager, who claimed that they did so after my written request because they thought I was wasn't serious. I am serious and it needs to stop. I am unsure of how to insure this does not continue because it appears they are not getting the message and continue to manufacture consent by stating that the rest of my family is okay with their children's images being used in this manner so it should be okay for me. I am an adult (over the age of 18) and my child is a minor (toddler).

Thank you for any help.

A: Sounds like you need to the help of an attorney to send a formal cease and desist letter. Beyond that, your only recourse is to file a lawsuit for Misappropriation of Likeness.

A: Do not see any patent angle here. Patents are a great tool but only for a very limited set of purposes.

Good luck.
