Q: What sate code governs child support cases where both parent has equal custody of the children?

I've been divorce for 4 years and the judge awarded my wife temporary alimony and child support due to salary differences. Since then, my ex-wife turned it over to the state and they are seemingly not familiar with child support with joint custody and they are using code OCGA 19-11-12 and increasing my support to her. I'm not going to ha e funds to buy food for them during the time they are with me. We both have them (2-boys) for a 2weeks of each month. My support payment will go from $605.00 to $1,035.00 and I did fill out a modification request to be considered for decrease or cancelation. The initial court order said I would pay the money directly to her but now my pension has been garnished.

No place in their system do they have any information about me have equal custody. When asked, I've been told there system don't work with shared custody.

A: You can hire an attorney and file for a modification in Superior Court. You don't have to go through child support enforcement to adjust child support, nor do you have to agree with their recommendation.

A: You need to retain private counsel if you are having these issues with the child support office. If you applied for a modification, you may have inadvertently caused them to raise your support. This is why you need an attorney to deal with it.
