Clinton, MS asked in Child Custody for Mississippi

Q: Who should get custody of this child?

My son has a 9 yr old daughter who was living in Westland, MI with her mom and mom's boyfriend. Sadly, the mom died from a heroin overdose and said child is living with boyfriend, or his sister or his mom, we are not really sure where she is or who exactly she is living with and we are deeply worried about her safety.

He has been trying to get custody for about 2 years now when this problem first started. We wer told to come get her by the Westland Police Department and we left the next day and drove 1000 miles up there and we never got to even see her let alone bring her back to Mississippi with us. Much more to tell but long story short If he is the only living parent with no criminal record who has a job and a home should he not be awared custody? Please help! we are desperate!

A: If the custodial parent passes away, then the non-custodial parent should be able to petition the court for custody over the minor child. Was there ever a child custody order entered into in Mississippi?
