Cordova, TN asked in Real Estate Law for Tennessee

Q: I got a Regency home built it in a upcoming community that was sponsored by Regency.I was told that it was built on lot

160.of course they they gave me a address when I move in over a year ago..During the first year whenever I had a Uber or a friend to pick me up ..they never could find my home. Now I know it was because there GPS was taking them to the REAL lot that the address belonged to.. I also had problems when it was time to pay property taxes because they were sending me taxes with the address that they assigned to me but my name and someone else’s name was on the paperwork making me think that someone was trying to make me pay there taxes .It all came down to them mixing up the lot #. It took several months to get someone to correct the problem so that I could make sure the right taxes were paid.My cable& security people recently came to change my equipment out so that the right equipment could be at the right address. They informed me that this mistake could have ended tragically if I would have had a intruder or a fire because help would have gone to the wrong address.Do I have a case

A: Who has made the mistake? You do not specify if it is in the Deed or just a problem at the Tax Assessor's Office. If it is in the Deed, then a suit in Chancery must be quickly filed naming many Defendants which you may or may not know the identity and/or address of. Did a lawyer perform a title search of your property? Did a lawyer draft your Deed? If this was just a Tax Assessor problem, then you will need to notify them to correct same, and no profitable suit is available. But if you were deeded the wrong house then many parties are liable for negligence and breach of title warranties, all of which have respective Statute of Limitations. Hire a competent attorney, and not a title company (which is probably the origin of your problem. Also if you have a Deed of Trust on the property, there will be other problems which could easily lead to Foreclosure. Hopefully you purchased Title Insurance which did not exclude this title defect.
