Q: Is my lease breakable?
My husband and i are in a lease with an apartment complex. i went on our apartments site and in our online documents it has our renters application. They filled it out while asking us the info. They also have the reports from doing the checks on if we were approved or not. My husband is listed on our lease as primary resident, yet his application says he was to be rejected. the report also shows my SS# wrong and that my SS# doesnt belong to me. That being said, does it make our lease valid? They also dont abide by their own lease. They dont keep common areas clean like they say they will in the lease. they dont fix some of the issues in the apartment, such as the missing wood on my flood that was reported in march. I have had the tulsa health inspector here and they said there are violations and will be doing a report and givng 10 days to fix. They moved me apartments and said they would continue my lease but instead started a new one and never gave me a copy.
A: Just because your husband's application shows rejected and your SS# is wrong does not invalidate your lease. The landlord and tenant act of Oklahoma sets out what the landlord is responsible for in the providing of certain things in your leased premises. They cannot start a new lease without your signatures. Demand a copy of that lease. Request in writing to the landlord to fix whatever conditions warrant in your leased premises.
