Q: How can I get a case dropped if the person who called the cops on me does not want to press charges?
How can I get a case dropped if the person who called the cops on me does not want to press charge. I was arrested for disorderly conduct/displaying firearm and unlawful possession of weapon?
A:
The state prosecutes criminal cases, not the alleged victim. The alleged victim can inform the prosecution and/or law enforcement regarding their position, but the ultimate decision is made by the prosecuting attorney for the state.
The alleged victim can help maximize the chances that the case will be dismissed by telling the prosecutor:
1). I hope you dismiss the case. This message carries more weight as a notarized affidavit.
2). I will only testify in court if subject to a subpoena.
3). I will NOT assist in preparing the prosecution for trial.
4). I will assist the defense in preparing for trial.
5). Thanks anyway but I am NOT in danger and I do NOT need you to protect me. I will call 9-1-1 if I need help.
Ultimately, the decision will be made by the prosecutor. There is a limited amount that the alleged victim can do to sway that decision.
