Asked in Divorce for Georgia

Q: Can I get back non-refundable retainer?

I hired a lawyer in Atlanta for filing a divorce. He sent me a agreement with non-refundable retainer but I did not sign it even I made a payment to him.

I made a payment to him on Saturday morning and he replied me that he will start my case on coming Monday. On the next day (Sunday night), I changed my mind, I don't want to get divorce and sent my lawyer an e-mail to cancel to filing a divorce and request a refund. Now, he refuses to refund due to the agreement with non-refundable retainer.

What can I do? I try to send him an email so many times, but he ignores and no reply.

A: No one can answer that question without knowing more information. Normally, a non refundable retainer means exactly that. If you think the fee is unfair, contact the fee arbitration department. https://www.gabar.org/committeesprogramssections/programs/feearbitration.cfm

A: Considering it was a non-refundable retainer there is a good chance you won't be able to get it back. Try speaking with the attorney to explain that you have changed your mind and see what options they offer. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
