Bell, CA asked in Civil Rights for California

Q: Were civil rights violated?

Police sat a 60 year old woman and myself in the back seat of a police car for over 1 hour while they trashed our residence. Never being in trouble with the law in our lives, we thought we were being arrested. When i asked police they laughed and said we were being detained for as long as they wanted and refused to let us sit somewhere else. There were 5 people in the home including a 5 year old boy. Police made fun of the idea child services where coming to take him away and one officer made crude comments towards the 5 yr old. I was yelled at in the back seat of car and i was so scared if i asked 1 more question i would be hurt. We were called names and video taped saying our names and never explained why. We were humiliated in front of neighbors. Police claimed it was a probation search going through everyones things including locked shed probationer had no access to, 3 females purses were dumped and things were broken. Car not probationers in driveway searched.

A: You haven't identified the one person among you who was the probationer and was entitled to be investigated by the probation officer. Nor have you identified your status in the household where the probationer was apparently residing, nor your relationship to the 60 year old woman who was put in the car with you. The point is that there is so much information missing that it is impossible to offer any reasonable legal advice under the circumstances.

If you suffered any injury, damage, loss or harm as a result of the occurrence, you should consult an attorney experienced in civil rights matters. Or, you can call the Los Angeles County Bar Association's referral service and they can refer you to an attorney with whom you can consult.
