Q: Would it be split?

My husband and I have been separated for 2 years, but not legally and he recently found out he has another child that is 13. The mother put him on child support and he has to now pay her $700 monthly as temporary order until Oct. The problem is now he doesn't do as much for my kids as he use to, because he has to pay CS. It's starting to upset, because it's not fair my kids have to lack. I get government assistance and don't get paid but $9hr, also I'm in school, and pay daycare. My kids are 2, 9, and 14. I know her income is much higher than mine. I was wondering would the CS split up evenly between our four kids or would she keep her amount and I will just get the amount left from his income as of CS deduction from his first case.

A: It doesn't work like that. Support is based on the state calculator, and what support he pays for the other child really has only a small impact on what he would pay for your children. Go to the Department of Child Support Services in your county and apply for child support. You don't have to be divorced to get it.
