Zephyrhills, FL asked in Civil Rights and Employment Discrimination for Florida

Q: I had turned in FMLA papers, my Principal still mentioned on my evaluations my disabilities....is this legally allowed?

He used this information to decide not to write me a new contract for this coming school year. I have been an effective/highly effective teacher for 32.4 years! 29.4 years count because the other years were temporary. Then, the union convinces you to resign, which I wish I would NEVER have done. Someone went into my attendance record and changed all my attendance reasons to erase what I put (erased my reason of FMLA) , and I have the evidence. HR handed it to me!

A: I'm so sorry that you are going through this. Are you saying that your boss made a decision regarding your future employment based upon a disability that you have? If that is so, you likely have a case, possibly for discrimination under the Americans With Disabilities Act, as well as the Family and Medical Leave Act. You should contact an attorney to see what your options are. Best of luck to you.
