Q: Tenant promised renovated roof deck
I have a question about tenant rights NYC. I signed a lease in November under the impression my deck would be renovated. Currently it is just an open roof space where neighbors can peer into my bedroom and have access to my apartment. I was told the roof deck will be sectioned off, and the flooring redone. As I signed my lease and sent in my first check, I was told the deck was being worked on as we speak. I have asked every month starting February 2018 about updates. I would get different excuses. I was told 2 wks ago it would be done this week. I call again today and find out they are not even going to touch the deck repair till next year. I lived in this building for 7 years. I recently changed units for a more modern apt. and deck space (a staple in NYC). I have email convos, texts msgs and phone calls recording their answers how the property manager kept reassuring me. I am paying $1,100 more a month for the deck. Do I have any rights or am I just a sucker?
A: Everything needs to be in writing. If everything you were promised (for the additional $1,000/month in rent) is in the lease, or addendum to the lease then you can take the landlord to court. If it isn't in writing, you won't get any relief. Good luck!
