Dallas, TX asked in Estate Planning for Texas

Q: How can I find out about a property in my dad's will that I can't find any info about? All I know is the city.

My father died in 2010, my sister was executor, but she died too. All I have is a copy of the will with no other documentation. The will mentions the property in the distribution to my son in the family trust. I remember my parents buying it when I was a child, but all I know is that it was in Pueblo, CO. ( The will is filed in Texas). How do I find out anything about the property? There is also stocks that were held in the trust until my son was 25, he's 27 now, but I have no idea what to do with any of this.

Also, the attorney who handled his will was disbarred years ago, so no help there.

Thanks!

A: The property should be listed in the county deed records of the county where it is located either under your father's name or that of his trust. Many county deed records are available online.

If the stocks are listed in the list of property attached to the trust document, try contacting the brokerage firm.

A: If the will was probated, I would request exemplified copies of the file or at the very least, certified copies of the file contents. As Ms. Garrett advised, the county where the property is located would have deed records.

You also mentioned a family trust; if there is a Trustee for that, you should contact them.

You may need to consult with a probate attorney in the State the will was probated as well as where the property is located.
