Q: After a petition to modify child support is filed along with a rule nisi request, what are the next steps in the proces?
I understand that in Dekalb Superior Court I will be given a date for a temporary hearing at which both parties will explain why/why not child support should be modified. Is the decision about temporary child support made right then, or are there additional hearings that must be held? I've heard of "status conferences" in Fulton county that seem to have to be held before temporary hearings for child support. In Dekalb county, will I have to have a status conference before the temporary hearing, or is that for later on after we have tried to mediate a permanent resolution? If my petition also includes a modification due to refusal to exercise visitation, could the contempt issue also be dealt with in the temporary hearing? Thank you for your time and help.
A: You need to go to the family law information center to discuss your case for free with an attorney. This isn't a proper forum for a full tutorial on handling your own custody case. There are simply too many steps.

A: You need to retain counsel to assist you with this. Why are you scheduling a temporary hearing? If you have the information to modify support, what is the point of prolonging the situation? Talk to an attorney about helping you with this so that you get this right and give the issue the attention it deserves.

A: It sounds as though you really need to consult with an attorney regarding your case. An attorney can review the facts in detail and help you plan the proper course of action. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
