Jefferson, GA asked in Divorce, Family Law, Child Custody and Child Support for Georgia

Q: I've been separated not legally for 3 yrs. 12yr old son lives with me and visits dad every weekend and holidays and

Summer. I've been on foodstamps and I've not asked for a dime in CS. I take care of all school and all dr visits. Dad gets funtime. In divorce papers I haven't filed yet (because I don't have an extra $250) but we've signed. We agreed to joint custody but I have physical custody and no CS. Will that hold up with a judge or will the ex have to pay? I do live with my boyfriend who pays all our bills and provides me with a car and my son and I with a cell phone? Are they any financial help with divorce in lumpkin county? Please help

A: He needs to pay child support. If you can't afford a divorce, then go to child support enforcement.

A: The court is not likely to accept your documentation if there is no support. It depends on the circumstances, and a skilled attorney may be able to work it out to where there is no support, but it is not likely. That said, you need to be getting support. Doing this just to get him to sign is going to cost you in the long run. You'd be better off going to court and taking your chances, even if it is on your own. I wish I knew of a way to get you some assistance in Lumpkin County, but I don't. Try calling the state bar or the local bars up there. Good luck to you.
