Asked in Child Support for Georgia

Q: I am wondering if I should file for Child Support or should I not bother considering the father has no income?

I decided not to put my child’s father on child support but am now considering it. My son is 4 years old. His father buys him clothes, shoes, and pays daycare every other month. He also gets him once per month on the weekend. He never signed the Birth Certificate so he has never established Paternity, although he was at the hospital during his birth. Technically he has no income. He has a 501c3 non profit and he supports it through “under the table” donations. He lives a very good life, often placing his possessions in another persons name to remain under the radar. I even have photos of my son at his house holding huge stacks of cash. I have seen him make more than $700 in a day. He is also a filmmaker and sells his products often in exchange for funds for his non profit by telling people they are supporting children. Since he technically has “no income: job”, should I pursue child support?

A: Non-profit doesn't mean no income. He clearly has an income and means to support his child. You have the option of setting up support through DCSS, but in this circumstance I would recommend private counsel. A private attorney is going to work harder to collect discovery and information about his employment than DCSS would. Call around and see what you are looking at for representation in this matter. Good luck.
