Q: Ex owes child support but was awarded spousal support by me, after child support I still owe him?

He hasn't paid child support in a year, he owes me $3700. He was awarded spousal support and after they took out the child support amount from that, I still owe HIM $160 a month. Wouldn't that come right back to me since he owes me support??

A: The master or DRO officer should have taken the arrears into account when he/she made the determination as to the actual bottom line amount you're to pay him. Perhaps there was an amount added onto what he pays for child support aimed at making a reduction in those arrears monthly. If you're uncertain about how this is supposed to work, you'd be better off contacting your caseworker. I agree that it doesn't seem right that you are paying him while he still owes you. Perhaps they can suspend the spousal support order until the child support arrears are cleared by the monthly spousal support.
