Q: Do I have to respond to production of docs. If they weren’t filed in court?

My sons fathers lawyer sent me a production of documents letter. But I feel like the stuff he is requesting is invasive. Plus why would I give you information since you took on a case against me to take my child? I filed for child support. He never showed up for testing but got a lawyer for visitation custody and tax credit along with court cost and fees. This man was in jail for 7 years of my sons life and almost been out for 4years and have not supported as much as he could. My son is now 11 and has had a phone for majority of the time and his dad does not keep in contact with him on a consistent bases. He currently lives with his girlfriend that is married that lives in public housing. Since my sons father has a record he shouldn’t be living their. He broke our order driving without valid lincense, and I even agreed that although his dad was not available for supervised visits that he could get him for a couple hours but they couldn’t go to his house. He lied and still took him.

A: If there is a pending child support/custody case, then the attorney can request documents relevant to the case, typically financial information to determine child support. You can file an objection with the court, and the court will decide if the requested documents are relevant. If so, and you do not provide them, the court can find you in contempt.
