Q: How to get child support lowered in KY?

This question is about a situation in Kentucky. Before I met my fiance 7 years ago, he had a child with another woman. He is 8 years old now and in the 8 years he's been alive my fiance has paid $250/ month in child support for him and has seen him maybe a handful of times. BUT, that order was put in place BEFORE we had our two kids, whom are 6 and 3. On that standard alone can he get that lowered? His ex is remarried to a man with a great job and she even does a couple of those "work from home" businesses. She mentioned him signing his rights over and her new husband adopting him but that's all we have heard of it. We struggle so bad because of the child support payment. I feel as though it is taking from my kids and keeping their dad out of jail. Someone please tell me what we can do.

A: The child support may be recalculated based on his and her income only , not their spouses. Because the eight year old is the oldest child, full support would be calculated and payable on him first. The credit toward child support would then be calculated and credited against his income when determining support for your younger children. You might want to do a test calculation of support on his and her income before you do anything, bc frankly, $250 per month is not an exorbitant calculation of child support under the KCSG.
