Q: Do I have a case if my car caught on fire due to a recall.

My car caught on fire on the 31st of July. On that day it was me and my two kids. i only had liability on the car with GAP insurance. The insurance isnt able to help me nor is GAP nor is the dealership. After looking up information, I found the car was on recall but didnt receive any type of documentation.

A: I'm sorry for your loss and the difficult situation it has put you in. I suggest you consult with a DTPA (Deceptive Trade Practice) lawyer in your area; one who has experience in vehicles. I'm not a DTPA lawyer and the only reason it comes to mind is I know one in San Antonio who has a lot of experience with auto companies; if you were here, I would refer you to him.

Among other factors, such an attorney could explore the adequacy and diligence of recall notices. Your description does not mention injuries, and I hope there were none, but there were injuries, you could also explore your rights with a Texas product liability attorney.
