Q: If I was divorced in one county but neither party lives in that county now, can I do a modification in my new county?
My ex and I were divorced in Newton County in 2016. As of this year, neither party lives there any longer. I need to look into getting a visitation/support modification due to the changes but I do not want to drive to Newton County in order to address these issues. Do I have to go to court on this in Newton County or can I file for the modification in the county which I currently reside?
A: The modification needs to be filed in the country where the responding party (respondent/defendant) resides. It does not need to be filed in Newton if the responding party still resides in Georgia.
