Q: My ex-wife said she would give me custody our autistic son, cause she can’t handle him, but has yet to sign papers

I have been wanting custody of our son the whole time we’ve been divorced, but she would not give me custody . She contacted me and told me she could not handle him. if I didn’t take him she was going to put him in a facility or find somewhere or something to do with him. I went ahead and took him into my home at that time before she signed custody paper. He has now been living in my home for four months, he’s enrolled in school, he loves living with me and my wife, and honestly throws a fit every time I have to take him for visitation with her. My whole problem is she still hasn’t signed custody paper And I’m paying child support to her for our child that is living in my home. I can’t afford to go to Jail and not pay it but I also can’t afford to continue to pay it and take care of him in my home. I think she is dragging it out just collect as much money from me as she can. What can I do to get her to sign these papers and also in the meanwhile get child support changed.

A: You are going to need to file a modification proceeding and get it on the docket if she wont sign. Not a do it yourself project, hire an attorney with experience helping people with these type cases.
