Q: In NJ , can my wife get child support to restart after child being 19 and working because she is taking online H.S. Dip.

My daughter dropped out of High School almost 2 years ago now she is taking an Internet course for H.S. Diploma, the Court stopped support just this month after her 19th birthday. My wife says all she has to do is refile with the Court to restart it, is that true after being out of school so long?

A: Your spouse can certainly file for child support and to have your daughter declared not to be emancipated. But whether or not she is successful is another story. An in person consultation with an experienced matrimonial attorney will be necessary to determine exactly what is reasonably likely to be the Court's decision. Do not let geographic restrictions get in the way of retaining the best attorney. Pick the best attorney you can find and remember one rule: a good attorney is generally never cheap, and a cheap attorney is generally never good so don't choose based on price.
