Q: Can I do emergency take away of my grandson if his dad(my son) is not ligitamized. Grandson in danger.

I have been getting my grandson for 7 to 12 days a month since birth. He’s almost 2 yrs old. The child’s father which is my son has not been ligitamized. However I have receipts of the financial care. He’s now in danger. The Mother has been in consulting for suicide and last month she attempted it. I have evidence and evidence that he has not been fed properly and has had to make trips to the Doctor and Emergency Room. She gave the doctor permission to share his medical records with me. I’m really concerned and don’t want my grandson in foster care.

A: The best option you have is to encourage your son to legitimize and take custody. You could file an independent custody case as well, or even file a private dependency application. Talk to an attorney about which option would be right for you based on the circumstances.
