Q: What are my tenant rights?

Lived in same apartment for 9 yrs. Never had problems with other tenants or landlord. Always paid rent on time. For those 9 years all tenants shared common driveway. There was never a problem between us. That same time, I also occupied storage in back of building with landlord's verbal permission free of charge. 6 mnths ago tenant next to me moves out and landlord's son moves in. Since then we (all tenants) have not known any peace. He is mentally unstable, has fits of rage and verbally threatens me and my family (and other tenants). He demanded that no other tenant can use driveway anymore, only he can (to keep peace we complied and now park in the street). Additionally he demanded that I vacate the storage immediately. I confronted landlord with these issues including his son's bursts of anger and threats he makes and that we live in fear now because of his son. Landlord says I should just move voluntarily (without compensation) to avoid further problems.

A: Your landlord's son harassment constitutes a violation of the Covenant of Peace and Quiet enjoyment. If the Landlord does not act to cure your complaint , you have a right to complaint to the police and ask for a restraining order against the son's threats and also, if after written notification to your landlord, he fails to act, and or discipline his son, you can ask an attorney to file a lawsuit and get you compensation for your moving expenses.
