Hanceville, AL asked in Child Support for Georgia

Q: Can he get child support lowered?

Ex husband recently retired from the army voluntarily at age 42. He is taking me back to court to have child support lowered because of change in his income. Would this be considered a voluntary reduction in pay and reason for him to get a job to help support our child? He learned a skill in the army (heavy equipment operator) and shouldn't have a problem finding a job but he says he doesn't want to work because it would interfere with his 1 weekend a month visitation. I'm in Ga and our divorce and custody was filed in Ga. He now resides in Texas with his current wife as she is in the army and that's where they are stationed.

A: There is no definite answer to this. The judge can assign him income based upon his skills. If he files a case, then talk to an experienced attorney about your options and how to defend the case.
