Colorado Springs, CO asked in Animal / Dog Law for Colorado

Q: My husband packed his personal belongings and left a month ago. He left his 3 dogs here, can I get rid of dogs

He has his son come by daily, after I leave for work, and sneak through the back yard and through a doggy door to feed them. These are large German shepherds and I won’t even go to my back yard with them out there. I have 2 dogs of my own, who come in the house. I want to clean up my backyard and play with my dogs out there but won’t with these 3 shepherds.

A: It appears he is showing ownership, still, and not that he abandoned them with you, if his son is still feeding them. If you are unable or unwilling to take care of them, then maybe you should talk to him about him taking them back or his son taking them. Failing to feed an animal in your custody could result in animal cruelty charges against you, so if you are not willing to take care of them, it would be best if you gave them to your ex or his son.

A: Have divorce proceedings been started? Does your husband co-own the home or co-lease it? Were the German Shepherds his before you got married or acquired during the marriage? Are the German Shepherds being left outside all day/night? Are the dogs vicious? There are a multitude of questions that you really need to answer with an actual consultation with someone well versed in this area of law, rather than just posting a question online. This is not a yes or no question.
