A: If the parties cannot agree on who will be responsible to pay the debt, then the court will decide that as part of the divorce. Debt incurred while married, could be split equally. Debt incurred prior to marriage, would probably remain that spouse's responsibility to pay. Your friend should use the Find a Lawyer tab to review all the facts and advise.
