Groves, TX asked in Criminal Law and Family Law for Texas

Q: Can you file with local PD for false accusations?

My son is going thru divorce just got done with mediation. And supposed to be at final hearing Friday. Since mediation his wife filed false family violence on him. Which we have proof of we think she is just so upset that she is trying to drag it out. Due to living free with plenty of extra money and a nice home. That she is loosing. Problem is when we went to police station they told us it would be a few weeks before detective could look at it. So it is our understanding that they could try to postpone final hearing for divorce. Which will cost him more $$

A: Swearing out a affidavit in support of a Family Violence protective order is the offense of Perjury. Calling the police to report a crime that did not happen is the offense of False Report to a Peace Officer. It is unlikely, however, that the police would be interested in pursing such charges... especially with anything other than indisputable objective evidence.
