Q: The mother and I signed away custody of our child to my mother while we were young. How do I get my custody back?

I was in my early 20s and disputing with the mother. The mom was and still is on drugs and a danger to the child. However, she dispised me and wanted to hurt me by keeping me away from my son, but could not take care of him. As a result my mom convinced the mom to sign custody over to her. Then my mom said the only how to get her to sign her rights was for me to sign mine over. I did to get my son out of the custody of his dangerous mother. That was almost 7 years ago. He has lived with me solely all this time and received 100% of support from me during this time. I would like to obtain legal and physical custody of him now and do not know how to do so. Please help me.

A: You need to schedule a consultation with an attorney to peel this onion back and see what needs to be done. It sounds like it may be a guardianship, but that is not necessarily the case. Guardianships are pretty easy to terminate, but it it is something else you may need to take a different approach. Contact an attorney and schedule an appointment to sit down and discuss this issue with them so that you both can create a plan of action and implement that plan as appropriate. Good luck.
