Celina, OH asked in Probate for Ohio

Q: OHIO- Brought to court last week with an extension noted for next month. Executor wont probate. How can we make file?

Brother of deceased named executor. Nearly 9 months later on seemingly easy estate he wont file because he wants some things out of the barn on deceased property.Clearly has no ownership but no one will listen. Two beneficiaries( children of deceased) are paying loan payments on house to avoid foreclosure, paying real estate taxes, mowing, painting, and making sure winterized. House insurance would have lapsed without their input. Executor wants some things in the barn that he claims were his. Beneficiaries state we know they were cleary our father's possessions, but to get the named executor out of the picture - you can buy out our half of the items since the deceased cant tell the truth, sign executorship over to one of us .Attorney filed motion to court to either make file or name third party. When got to court last week, both attorneys in private spoke and now it is pushed off another month, giving named executor a chance to "change" or update list. What gives? help!

A: The probate court supervises estates. The court gave more time, which is not unusual. Talk to the attorneys. Or if you or another family member are not represented by an attorney, use the Find a Lawyer tab to retain a local probate attorney to review the facts and advise you of your options.
